TERMS OF USE

  1. Introduction
    1. This document sets out the terms and conditions (“Terms”) that govern the use of PETAL KOLA Market Platform and KOLA-ADs Classified Advertisements Platform (“Services”) provided by ALL PETAL Inc. ( “we”, “us”, or “our”).
    2. The Services allow you, as a PETAL KOLA vendor and a KOLA-ADs member, to buy and sell online, post and view classified advertisements for various products and services on two exclusive platforms provided by us.
    3. By using the Services, you agree to be bound by these Terms and our Privacy Policy, which forms part of these Terms. If you do not agree with these Terms or our Privacy Policy, you must not use the Services.
    4. We may change these Terms at any time without prior notice. The latest version of these Terms will be available on our website/s. By continuing to use the Service after any changes, you agree to be bound by the updated Terms.
    5. These Terms are governed by and construed in accordance with the laws of the Republic of Uganda. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of Uganda.
  2. Eligibility
    1. The Services are open and available to all PETAL KOLA and KOLA-ADs subscribers  with an email address,  a valid National ID or Passport or other legally recognized identity document.
    2. You must be at least 18 years old and legally capable of entering binding contracts.
  3.  The Services Description
    1. The Services allow you to buy and sell online,  post and view classified advertisements for various products and services on two exclusive platforms provided by ALL PETAL Inc.
    2. You may access the platforms through a web portal,  or a mobile app, as specified by us from time to time.
    3. You may choose from different categories of advertisements, such as  appliances and electronics, property and real estate, jobs, service provider, among others, as well as different features, such as prices, location, etc.
  4. Fees
    1. A nominal fee is required for displaying and posting an advertisement. The fee varies depending on the category, duration, and features of the advertisement.
    2. You can view the applicable fee for each advertisement before posting it and confirming the payment.
    3. You may also contact Our support Team to guide you on how to transact  and do business on the platforms. Reachable on support@petalkola.com, whatsapp : 0744 342 140.
    4. The fee is non-refundable and non-transferable, unless otherwise stated by us.
  5. Service Rules
    1. You are solely responsible for the content and accuracy of your  e commerce goods and services and advertisements. You must ensure that your e commerce goods and services and advertisements comply with these Terms, our Privacy Policy, our Brand Guidelines, and applicable laws and regulations.
    2. You shall not sell, display nor post any goods and services or advertisement that is false, misleading, fraudulent, defamatory, obscene, offensive, abusive, hateful, discriminatory, illegal, or infringing on the rights of others.
    3. You shall not sell, display nor post any goods and services or advertisement that promotes or facilitates any illegal or prohibited activity, such as gambling, drugs, weapons, prostitution, etc.
    4. You shall not sell, display nor post any goods and services or advertisement that contains any personal or sensitive information of yourself or others, such as name, phone number, email address, bank account details, etc., without their consent.
    5. You shall not sell, display nor post any goods and services or advertisement that contains any virus, malware, spyware, or other harmful software or code.
    6. You shall not sell, display nor post any goods and services or advertisement that interferes with the operation or security of the platforms.
    7. You shall not display or post any advertisement that duplicates or copies any other advertisement on the platforms or elsewhere.
  6. DISCLAIMER.
    1. We do not guarantee the quality, authenticity, or legality of the products and services sold advertised, nor do we endorse or verify any claims made by the advertisers or buyers.
    2. We are not responsible for any disputes, damages, or losses arising from the transactions between the parties.
    3. We are not involved in any communication or negotiation between the parties.
    4. We do not provide any payment, escrow, warranty, insurance, or dispute resolution service for the transactions between the parties on Our KOLA-ADs platform.
    5. You are advised to exercise caution and due diligence when dealing with other parties on the platforms.
  7. Modification
    1. We reserve the right to reject, remove, or modify any  goods and services, vendor, member or advertisement that violates these Terms or any other reason without prior notice or liability.
    2. We also reserve the right to suspend or terminate your access to the platforms for any reason without prior notice or liability.
  8. Personal Information
    1. We may use your personal information, such as name, phone number, email address, location, and transaction history, for the purposes of providing the Services, improving customer experience, conducting market research, sending promotional messages, and complying with legal obligations.
    2. You consent to such use by using the Services.
    3. We may also share your personal information with third parties who provide services related to the Services, such as platform providers, payment processors, advertisers, etc., subject to their privacy policies.
    4. You consent to such sharing by using the Services.
    5. We will take reasonable measures to protect your personal information from unauthorized access, use, disclosure, or loss.
  9. Governing Law
    1. These Terms are governed by and construed in accordance with the laws of the Republic of Uganda.
    2. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of Uganda.
